Family
Nicola undertakes a range of family work including Private Law Children, Non-Molestation and Occupation proceedings, Ancillary Relief and Public Law Children. She also undertakes work relating to Co-habitation and applications under TLATA 1996 and Children Act, Schedule 1.
Nicola has advised or appeared in cases involving:
- Domestic violence – both in Children Act and injunction proceedings
- A range of Section 8 orders including shared residence orders
- The seeking and preventing of removal of children from the jurisdiction
- Children with special needs (such as those on the autistic spectrum)
- Parents with learning difficulties, psychological and psychiatric problems
- Alcohol and drug abuse by parents
- Allegations of sexual and physical abuse of children
- Applications for residence and contact by step-parents and grandparents
- freestanding application for a declaration of parentage utilising directions for scientific testing and the drawing of inference in the event of non-compliance with directions
- Applications for injunctions under the Protection from Harassment Act 1997, both independently of and in conjunction with applications under the FLA 1996
- Variation of maintenance orders and enforcement of arrears
- Applications for orders preventing disposition of assets outside of the jurisdiction pending ancillary relief hearing
- Applications under TLATA 1996 for declarations of trust in property held by former co-habitees, both where property is vested in joint names and in the sole name of one party
- Applications for Liability and Committal Orders under the Child Support Agency legislation on behalf of both applicant and respondent
