Public Law & Regulatory

Michael accepts instructions on all aspects of public and administrative law. He has particular experience in tax law and human rights and constitutional law.

Michael shadowed David Southern in the House of Lords case of Fleming v Conde-Nast v HMRC, and while working as a judicial assistant at the Court of Appeal he worked on R (Gaines-Cooper & Davies) v HMRC. He also wrote an opinion on the landmark cases of Ladele v Islington Borough Council (Liberty intervening) (appeal from the EAT on whether a Christian registrar could object to joining same-sex couples in civil union on the grounds of her religious belief), and R (Orobator) v Secretary of State for Justice (whether the Claimant had suffered a flagrant denial of justice in Laos such that her continued incarceration in the United Kingdom was a breach of her Article 5 right to liberty).

Michael has a niche practice in housing law. He successfully acted for the landlord in Dunn v Ostick, which was an appeal against a District Judge’s application of subsection 214(4) of the Housing Act 2004, which obliges landlords to pay a penalty sum equivalent to three times the amount of their tenant’s deposit back to the tenant where the landlord has failed to properly comply with the statutory scheme.
