Public Law & Regulatory

In conjunction with his criminal practice, Mark Sullivan has considerable experience and expertise in prosecuting and defending in regulatory matters. He was previously instructed by the DBIS (formerly DTI) and the HSE  in criminal matters, although he now specialises in representing individual and corporate Defendants.

He has appeared in cases brought by the HSE, Trading Standards, the Environment Agency, Fire Authorities and VOSA, amongst others. In relation to his Health & Safety work he is able to draw on his expertise in employer’s civil liability matters as well as his general criminal experience.

Current and recent cases include:

  • R v R Ltd and others – appeared as junior prosecuting counsel in HSE/ CPS prosecution following a serious accident on a building site leaving a young man paraplegic;
  • R v L – represented owner and operator of an hotel following the electrocution of a member of his staff;
  • R v C Ltd. – represented the owner and operator of a club in case brought by Environment Agency for pollution of a water course;
  • VOSA v Gibbs Transport [2006] EWCA 1109 (Admin) – meaning of “nearest available weighbridge” under RTA 1988, section 41B(2);
  • DBIS v F & D – represented Defendant in case brought by DBIS in relation to alleged breaches of the Employment Agencies Act 1983.
